Terms of Use

Effective 26 September 2026

1. About these terms

These terms are an agreement between you and Leo Mitchell, trading as Spirian (ABN 48 266 141 131). “Spirian”, “we” and “us” mean that business.

They apply to Spirian Worksheets, the web app at app.spirian.com.au, and to the Try it page on this website (section 12). By using either, you agree to them. If you use it for a tutoring business, you agree on that business’s behalf, and “you” includes the business.

Our privacy policy explains how we handle personal information.

2. Private testing

Spirian Worksheets is in private testing. That means:

  • Access is by invitation, and we create your account.
  • It is free during testing, within the usage limits we set for your account.
  • Features will change, and some may be removed. The app may be unavailable at times.
  • If we start charging, we will tell you the price first. You will only pay if you agree to it.

3. Your account

  • You must be 18 or over and use Spirian Worksheets for teaching or tutoring.
  • Each account is for one person. Do not share your password. If other tutors in your business need access, ask us for their own accounts.
  • You are responsible for what happens under your account. Tell us straight away if you think someone else has used it.

4. Our questions and what you may do with them

Spirian owns the copyright in the question library: the question templates, every question drawn from them, and the worked solutions, marking rubrics and diagrams that come with them. We call all of this “library content”.

While your account is open, we give you a licence to use library content for teaching. You may:

  • give it to the students you teach, on paper or on screen, as worksheets, homework, tests or revision, including in paid tutoring;
  • share it with other tutors in your business, for teaching your business’s students;
  • edit it, adapt it and combine it with your own material, for that same teaching.

You may not:

  • sell, license or give away library content, or anything made mostly from it, as a product in its own right, such as a question bank, workbook or resource pack;
  • publish it where the public can see it, including websites, social media and resource-sharing sites;
  • use it to train, test or improve an AI model, or to build a question bank or service that competes with ours;
  • copy library content out of the app in bulk, or use automated tools to do so;
  • remove any notice that says the content is ours.

The licence cannot be transferred, and it ends when your account closes. Material you have already given to your students before then can stay with them.

Nothing in these terms transfers ownership of Spirian Worksheets, the engine behind it, or library content to you.

5. Your own content

You own the questions, solutions and other material you write in the app. You give us permission to store it, process it and show it back to you, only so we can run the service for you.

We do not add your material to our library, show it to other customers, or use it to train AI models.

6. Uploading your own questions

We plan to let you upload a question you own and get variants of it back. That feature is not available yet. When it is:

  • the variants generated from your question belong to you, and you can use them however you like;
  • we keep ownership of the engine and the general methods it uses, but we will not give your question or its variants to anyone else.

We will add any further detail here before it is switched on.

7. Only use material you have the right to use

Only enter or upload material that you wrote yourself, or that you have permission to use this way. In particular, do not enter or upload:

  • questions from past HSC or other official exam papers;
  • questions from textbooks, published workbooks or paid resources;
  • material written by another tutor or business;
  • anything that identifies a student.

You are responsible for having the rights to what you enter. If material breaches this section, we may remove it, and you agree to cover our costs if a claim is made against us because of it.

If you think something in Spirian Worksheets infringes your copyright, write to [email protected] and tell us what it is and why. We will look into it and act promptly.

8. Checking the maths

Every question template in the library has its method proven by a computer algebra system before any question drawn from it is released. When something cannot be proven, it is flagged and held back.

That proof shows the working is correct. It does not show that a question suits your students or asks exactly what you intend. Review each question before you use it. You decide what you teach.

If you find an error, please tell us. Finding them is how the library gets better.

9. Using the service fairly

You must not:

  • try to get around usage limits, security measures or access controls;
  • copy, decompile or reverse engineer the app, except where the law allows it;
  • access the app with scripts or other automated tools, or put an unreasonable load on it;
  • use the service for anything unlawful.

10. Your rights under Australian Consumer Law

Nothing in these terms limits your rights under the Australian Consumer Law that cannot be excluded.

Apart from those rights, and to the extent the law allows, Spirian Worksheets is provided as it is during testing. We are not liable for indirect loss, such as lost profit or lost data. Our total liability to you is limited to the amount you have paid us in the twelve months before the claim. While the service is free, that amount is nil.

Where the law does not allow us to exclude a guarantee but lets us limit it, our liability is limited to supplying the service again, or paying the cost of having it supplied again.

11. Suspending or closing an account

You can close your account at any time by writing to [email protected].

We may suspend or close your account if you seriously or repeatedly break these terms, or if we end the testing program. We will give you reasonable notice where we can, and a chance to keep a copy of your own content.

Sections 4 (what you may not do), 7 and 10 still apply after your account closes.

12. The Try it page

Anyone can use the Try it page without an account. The worksheets you make there, and the copy we email you, are library content.

You may use them for your own teaching, as section 4 allows. The same limits apply: do not sell or publish them, do not use them to train an AI model, and do not copy questions from the page with scripts or other automated tools.

The page is a demonstration. It is provided as it is, and section 10 applies to it as it does to the app.

13. Changes to these terms

We may update these terms as the product changes. We will email you before a significant change takes effect. If you keep using Spirian Worksheets after that, the new terms apply. The current version is always at spirian.com.au/terms.

14. Governing law

These terms are governed by the law of Western Australia. You and we submit to the courts of Western Australia and the courts that can hear appeals from them.
